Florida’s dispute with porn websites involves several separate legal actions—not one lawsuit. A 2025 challenge by the adult-industry group Free Speech Coalition to Florida’s age-verification law was dismissed after the U.S. Supreme Court upheld a similar Texas law. Florida later filed enforcement complaints alleging that companies tied to several adult sites failed to comply. The law remains the key issue: it requires covered commercial websites to verify users are 18 or older, and some sites—including Pornhub—responded by blocking Florida access rather than adopting verification.
What Florida’s law requires
Florida enacted its online age-verification requirement in 2024 as part of legislation commonly known as HB 3. The requirement took effect on January 1, 2025. It appears in Florida Statutes § 501.1737, with related provisions in § 501.1738.
The law applies to a commercial entity that knowingly and intentionally publishes or distributes material harmful to minors on a website or application if more than 33.3% of the site’s total material is covered material. The statute’s definition requires that, taken together, the material appeal to prurient interest under contemporary community standards, depict or describe sexual conduct in a patently offensive way, and lack serious literary, artistic, political, or scientific value for minors.

Florida permits either “anonymous age verification” as defined in the statute or a “standard age verification” method the entity considers commercially reasonable. That does not mean every user must upload a driver’s license: the law does not mandate one universal technical method. Nor does the word “anonymous” alone establish that a particular system collects or retains no identifying information. Privacy depends on what the verification provider receives, what the website sees, whether records are retained, and whether information can be linked across services.

The law primarily regulates the commercial entity publishing or distributing the covered material. It says an internet service provider, search engine, or cloud provider does not violate the provision merely by connecting users to content or providing access to a site it does not control, provided it did not create the material. The statute is not a crime for an adult simply to try to visit a website.
Florida also provides exemptions for bona fide news and public-interest material and protects news-gathering organizations’ rights. The serious-value test and exemptions matter for education, health, art, documentary, and political material, but they do not automatically exempt every site in those categories. The site’s overall content, commercial status, proportion of covered material, and statutory interpretation can all matter.
Why Pornhub blocked Florida
When the law took effect on January 1, 2025, Pornhub’s parent company, Aylo, blocked Florida users. Contemporary reporting described the move as the company’s response to the law and its concerns about privacy and implementation. A company choosing to deny access from Florida is not the same as the state formally blocking the website, and neither is the same as a court ordering it to stop operating.

Some Florida residents therefore experienced the change as a ban, even though the statute is an age-verification mandate rather than a facial prohibition on adult pornography. Access can differ by site, domain, location, device, and operator policy; it would be inaccurate to assume every adult website is inaccessible statewide. Geolocation systems can also affect visitors and people traveling through Florida, even if they do not live there.

The Free Speech Coalition’s challenge
The first major lawsuit was brought by the Free Speech Coalition and other plaintiffs from adult-content, sexual-wellness, sex-education, and legal fields. They argued that Florida’s requirement burdens adults’ access to protected speech, risks exposing sensitive browsing or identity information, may reach beyond conventional commercial pornography, and could chill lawful, anonymous access. They sought to block the law. The coalition’s account of the challenge and its arguments is available in its announcement of the Florida lawsuit.
The challenge was dismissed in July 2025, after the Supreme Court decided a similar dispute involving Texas. That dismissal did not repeal Florida’s statute or amount to a Florida-specific merits ruling declaring the law constitutional. It also did not resolve separate litigation over other provisions of Florida’s 2024 law.
What the Supreme Court decided—and what it did not
On June 27, 2025, the Supreme Court ruled 6–3 in Free Speech Coalition v. Paxton that Texas’s age-verification requirement was constitutional under the applicable level of scrutiny. The majority treated the requirement as an incidental burden on adults’ access to protected speech while recognizing the government’s important interest in preventing minors from accessing pornography. The Court’s opinion concerned Texas law, not Florida’s.

Florida’s enforcement complaints against website operators
These cases are distinct from the industry’s constitutional challenge: Florida is the plaintiff, and the defendants are companies the state says operate or are associated with covered websites. On September 15, 2025, Attorney General James Uthmeier announced two complaints.
One complaint named Gethins Limited, Toccata, Inc., Segpay Gateway LLC, Segregated Payments, Inc., and entities doing business as Segpay. The state said the case concerned xh.lustyheroes.com, which it described as distributing pornographic video-game content without compliant age verification.
The second complaint named Aylo Holdings USA Corp., Aylo Billings US Corp., Aylo Group Ltd., and Nutaku Entertainment Ltd. The Attorney General associated those defendants with Nutaku.net, SpiceVids.com, PornHub.com, RedTube.com, Tube8.com, and YouPorn.com. Florida alleged that SpiceVids and Nutaku lacked a compliant age-verification process. These are allegations in complaints, not findings that every named company or website violated the law.
The state sought injunctions and compliance orders, civil penalties, attorneys’ fees, and costs. The Attorney General said violations can carry fines of up to $50,000 per violation. That is a stated maximum, not a prediction of liability: the number of violations, defenses, court findings, and any settlement would determine an actual outcome.

The announced complaints establish that Florida initiated enforcement actions, but they do not by themselves establish a final judgment, settlement, or present-day docket status. No final merits outcome is established by the cited announcement. Readers looking for a current case result should distinguish the original filing and requested relief from any later court order.

- For adults: The law targets covered commercial publishers, not the adult user attempting to view material. A website may nevertheless deny access rather than build or adopt a verification process.
- For privacy: Age checks vary. An ID upload, facial-age estimate, third-party verification token, or device-level age assurance can expose different information and carry different reliability and retention risks. The statute does not require every site to use the same approach, and its “anonymous” category does not prove that a given implementation is anonymous in practice.
- For mixed-content services: The more-than-33.3% threshold can raise difficult questions for platforms hosting user uploads, sexual-health resources, fan services, games, or other varied material. A site’s own label is not necessarily conclusive; the statutory definitions and actual content matter.
- For visitors and residents: The statute defines a resident as someone who lives in Florida for more than six months of the year, but sites may rely on IP address or other location signals that also affect visitors, students, military personnel, or travelers. Availability may therefore depend on a site’s technical and business choices.
What may happen next
The legal and policy questions are separate. Florida’s enforcement complaints concern whether particular entities complied with the existing statute; the Free Speech Coalition case concerned whether the mandate could be blocked on constitutional grounds. Separately, Axios reported on August 4, 2026, that Aylo was seeking a path back into Florida and urging policymakers to reconsider age-verification laws. That is a policy campaign, not evidence by itself of a new lawsuit or a change in the law.
Unless Florida changes the statute or a court orders otherwise, covered entities remain subject to the age-verification requirement. The unresolved practical questions include how courts apply the content threshold to mixed sites, what verification systems satisfy the law, and the outcomes of the state’s enforcement cases.

Is Pornhub banned by the state in Florida?
The cited reporting says Pornhub’s parent company blocked Florida access in response to the law. That company decision is different from a government-imposed website ban.
Does Florida require every visitor to upload a driver’s license?
No. The statute allows anonymous age verification or a commercially reasonable standard method; it does not prescribe one method for every site.
Did the Supreme Court rule on Florida’s law?
